Is a clothing allowance mandatory in construction?

Who actually pays for work clothing in construction? And is a construction worker entitled to a clothing allowance? These are questions that arise regularly, both among employees and employers in the construction sector. The rules surrounding clothing allowance are not always clear and depend on several factors.

In this article we explain what the rules are regarding clothing allowance in construction, when an employer is obliged to provide work clothing and what is regulated in the collective labor agreement.

What is a clothing allowance?

A clothing allowance is a financial compensation that an employer gives to an employee for the purchase or maintenance of work clothing. This can be a fixed monthly allowance, an annual contribution or an arrangement whereby the employer purchases the work clothing itself and provides it to the employee.

In practice, there are two main forms: the employer provides the clothing himself, or the employee purchases the clothing himself and receives compensation for it. Which form applies depends on the collective labor agreement, the employment contract and the nature of the work. Sometimes a combination of both applies: the employer provides certain items of clothing and reimburses others.

Is a clothing allowance legally required?

There is no general law that obliges employers to pay a clothing allowance. The Working Conditions Act does oblige employers to provide personal protective equipment (PPE) if the work requires it. Think of safety shoes, helmets and... high visibility clothing. This obligation also applies to work clothing that is specifically required to work safely.

If it concerns ordinary work clothing that does not primarily serve as protective equipment, the employer is not automatically obliged to provide or reimburse it. Unless this is stated in the collective labor agreement or employment contract.

What does the Construction Collective Labor Agreement say?

In the collective labor agreement for the Construction Industry, agreements have been made about work clothing and clothing allowance. The exact content of these agreements may change per collective labor agreement period, but employers are generally obliged to provide certain items of clothing or to contribute to their purchase. For certain functions or activities this may deviate from the general rules.

Always consult the most recent version of the Construction Industry Collective Labor Agreement for the current agreements. The collective labor agreement is available via the website of the relevant employers' and employees' organizations in construction. If there is any uncertainty, consultation with the works council or trade union is the appropriate course of action. They can help to clearly map out the rights and obligations.

What if the employer does not provide compensation?

If an employee is entitled to a clothing allowance based on the collective labor agreement or the employment contract and the employer does not pay it, then there is a failure to comply with the agreements made. In that case, the employee can address the employer in writing. In case of persistent disputes, the union or a legal advisor can be called in to mediate or take further steps.

Employers are wise to clearly record the clothing rules and allowances in the employee handbook and to discuss them upon hiring. This prevents misunderstandings and discussions afterwards and provides a clear framework for both parties.
